I repeat: Dream on. Roberts is sensitive to the Court’s public reputation, and will seek to avoid what he sees as the Rehnquist Court’s mistake in intervening in Bush v. Gore. I think he will look for a procedural off-ramp (standing, jurisdiction, etc.) to avoid reaching the constitutional issue.
